Terms Of Service

ABSOLUTE YOGA LTD CONSUMER TERMS

These Terms apply when you buy Yogi Bare or Resette products from our online store as a consumer.

Yogi Bare and Resette are trading brands of:

When you buy from either brand, your contract is with Absolute Yoga Ltd.

Separate terms apply to wholesale and other business-to-business purchases.


1. Which Terms Apply to Your Order?

These Consumer Terms apply to all consumer orders placed through our online store.

Depending on what you buy, your order may also be subject to:

  • our Shipping Policy;

  • the relevant Yogi Bare or Resette Returns, Refunds & Complaints Policy;

  • the Product Policy that applies to the product; and

  • any product-specific terms or warnings made available to you before you place your order.

These documents form part of your contract with us where they apply to your order.

If your order contains products from both Yogi Bare and Resette, these Consumer Terms apply to the whole order.

Any brand-specific or product-specific terms apply only to the relevant product. If there is a conflict, the more specific terms take priority for that product.

Instructions supplied with a product explain how to use and care for it safely. They do not reduce your statutory consumer rights.


2. Your Consumer Rights

Nothing in these Terms takes away any rights that the law gives you as a consumer.

Our products must be as described, of satisfactory quality and fit for purpose where required by law.


3. Product Information

We take reasonable care to make sure that product descriptions, images, prices and other information on our website are accurate.

Colours may look slightly different depending on your screen or device.

Minor variations may also occur between individual products where these do not materially affect their quality, safety or intended use.

Please read and follow any instructions, warnings and other product information provided on the product page or supplied with the product.


4. Placing an Order

When you place an order, you are offering to buy the products in your basket.

We will send you an email confirming that we have received your order. This is an acknowledgement only and does not mean that we have accepted it.

Unless we tell you otherwise, a contract for each product is formed when we confirm that the product has been dispatched.

Taking or authorising payment does not by itself mean that we have accepted your order.

If we take payment for an order that we do not accept, we will refund the amount paid.


5. When We May Refuse or Cancel an Order

Before accepting an order, we may refuse or cancel it if, for example:

  • a product is unavailable;

  • payment cannot be authorised;

  • we cannot deliver to your address;

  • there is an obvious pricing or product-information error;

  • the sale is restricted by law;

  • we reasonably suspect fraud or unauthorised resale; or

  • a purchase limit shown on the product page or at checkout has been exceeded.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled product.


6. Prices & Payment

The total price payable to us, including VAT where applicable, delivery charges and any other mandatory charges, will be shown before you place your order.

We may change our prices at any time, but this will not affect an order we have already accepted.

If a price is obviously incorrect and you could reasonably have recognised it as a mistake, we may reject the order before dispatch and refund any payment taken.

The payment methods available to you will be shown at checkout.

Payments may be processed by third-party payment providers.

If you choose a credit or deferred-payment option, the payment provider's own eligibility requirements, disclosures and terms will also apply.


7. Delivery

Our Shipping Policy explains:

  • delivery charges;

  • estimated delivery times;

  • international shipping and customs;

  • what happens if an order is delayed or cannot be delivered; and

  • what to do if an order arrives damaged or incorrect.

Please make sure that the delivery information you give us is complete and accurate.

Nothing in these Terms or our Shipping Policy transfers risk in the goods to you earlier than consumer law allows.


8. Cancellations, Returns & Refunds

Your cancellation, return and refund rights are explained in the Policy that applies to the product you buy:

  • Yogi Bare Returns, Refunds & Complaints Policy; or

  • Resette Returns, Refunds & Complaints Policy.

The relevant Returns Policy forms part of your contract with us.

Different products may have different return conditions, so please check the relevant Returns Policy before using or opening your product.

Nothing in our Returns Policies takes away any consumer rights that cannot legally be excluded or restricted.


9. Additional Product Guarantees

An additional commercial guarantee applies only where we expressly offer one for the relevant product.

Any guarantee will explain:

  • what it covers;

  • how long it lasts;

  • how to make a claim; and

  • any conditions or exclusions that apply.

A guarantee offered for one product or brand does not automatically apply to another.

Any additional guarantee is separate from your statutory consumer rights.


10. Using Our Website

Please use our website lawfully.

You must not:

  • interfere with the operation or security of the website;

  • introduce viruses, malicious code or other harmful material;

  • attempt unauthorised access to our website or systems;

  • unlawfully scrape or extract website content;

  • use the website fraudulently; or

  • infringe our rights or the rights of anyone else.

We may take reasonable steps to protect our website, systems, customers and business where reasonably necessary to prevent or address misuse.


11. Our Content & Intellectual Property

Our brand names, trade marks, website content, photographs, graphics, text and other original material belong to us or our licensors unless stated otherwise.

You may use our website and its content for your own personal, non-commercial use.

You must not copy, reproduce, distribute, commercially exploit or modify protected content without permission, except where the law allows you to do so.


12. Reviews, Feedback & User Content

If you submit a review, photograph, video, comment or other content to us, you confirm that:

  • the content is your own or you have the right to submit it;

  • you have permission from anyone who appears in the content;

  • it does not infringe anyone else's rights;

  • it is not unlawful, abusive, defamatory or discriminatory; and

  • it does not deliberately mislead people about your identity or experience.

By submitting content to us for review, publication or sharing, you give Absolute Yoga Ltd a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content on:

  • our Yogi Bare and Resette websites; and

  • social media channels operated by Absolute Yoga Ltd, Yogi Bare or Resette.

This licence allows us to resize, crop or reformat photographs and videos where needed for display. We will not materially change the meaning of a customer review.

You continue to own any rights you have in your original content.

We may moderate or remove content that breaches these Terms, our review guidelines or applicable law.

Where a review or other content has been incentivised, gifted or provided as part of a commercial relationship, we may identify it as such where required.


13. Third-Party Services & Links

Our website may use or link to services provided by third parties, such as:

  • payment providers;

  • delivery companies;

  • social-media platforms; and

  • other technology providers.

We are not responsible for the content or practices of third-party websites or services that we do not control.

Your use of a third-party service may also be subject to that provider's own terms and privacy policy.

Our use of a third-party provider does not reduce any responsibility that we have to you under our contract or applicable consumer law.


14. Privacy & Cookies

Our Privacy Policy explains how Absolute Yoga Ltd collects and uses your personal information, including information collected through cookies and similar technologies.

It also explains the types of cookies and similar technologies we use and how you can manage your choices.

Our Privacy Policy does not form part of your purchase contract.

Where consent is required for marketing, cookies or similar technologies, we will ask for that consent separately.


15. Our Responsibility to You

Nothing in these Terms excludes or limits liability where the law does not allow us to do so. This includes liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; and

  • consumer rights that cannot legally be excluded or restricted.

If we breach our contract with you, we are responsible for loss or damage that was a reasonably foreseeable result of that breach.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was made.

Products bought under these Consumer Terms are supplied for personal and domestic use.

We are not responsible under a consumer contract for business losses such as:

  • loss of profit;

  • loss of revenue;

  • loss of business opportunity; or

  • business interruption.


16. Events Outside Our Control

Sometimes events outside our reasonable control may delay or prevent us from carrying out our obligations.

If this happens, we will take reasonable steps to reduce the effect on you and will contact you where appropriate.

This does not affect any legal rights you may have, including rights relating to delayed or undelivered goods.


17. Complaints

If something goes wrong, please contact us and we will work with you to resolve it.

The relevant Yogi Bare or Resette Returns, Refunds & Complaints Policy explains how to make a complaint and how we handle it.

Making a complaint does not affect your legal rights.


18. Governing Law

These Terms and your contract with us are governed by the laws of England and Wales.

If you live elsewhere, you also keep the benefit of any mandatory consumer protections that apply to you.

Nothing in this section limits any right you may have under applicable law to bring proceedings in a court available to you.


19. Changes & Previous Versions

Each version of these Terms has a version number and effective date.

The version made available to you before you place your order will apply if we accept that order.

Changes we make later will not change your existing contract unless:

  • the law requires the change; or

  • you expressly agree to it.

We keep previous versions so that we can identify which Terms applied to earlier orders.


20. Other Legal Points

If any part of these Terms is found to be unlawful or unenforceable, the rest of the Terms will continue to apply.

Your contract is between you and Absolute Yoga Ltd. No other person has the right to enforce it unless the law gives them a separate right to do so.
